  OIADA must be a constant presence in monitoring current legislation within our state.   We need to interpret legislative activity that may impact our industry.  It is the association’s responsibility to maintain an ongoing relationship with governmental officials and regulatory agencies.  Your voluntary PAC contribution helps our legislative representatives work for you, the independent auto dealer.   OIADA has worked on many issues affecting dealers such as stopping the 3 day right of rescission, getting temporary motorcycle permits that actually fit on the rear plate area, extension of DEQ slips from 90 days to 180 days, all new broker disclosure forms, new silver dealer plate that makes us really look like a dealer, opposing no sales on Sunday, saying no to a big increase in DMV fees, as well as ongoing dealings with regulatory agencies, just to mention a few.  An added benefit to making a political contribution is the Oregon Tax Credit.  You can take this directly off your state tax liability.  The credit is $50 for an individual and $100 on a joint return.

OIADA Members – New Benefits – Red Flags Rules

Here is Your Compliance Program on the Identity Theft Red Flags Rules – The rule states that each business has a written plan to detect, prevent & mitigate ID Theft.

 

The Final Rules require each financial institution and creditor that holds any consumer account, or other account for which there is a reasonably foreseeable risk of identity theft, to develop and implement an Identity Theft Prevention Program (Program) for combating identity theft in connection with new and existing accounts. The Program must include reasonable policies and procedures for detecting, preventing, and mitigating identity theft.

 

Upon your request, OIADA will email/mail you a program that will allow you to develop and implement your own program on Identity Theft Prevention. We will provide the tools for you. All you will have to do is make it specific to your individual dealership needs. This program will include reasonable policies and procedures for detecting, preventing, and mitigating identity theft.

 

 

What your program will include:

  1. A list of 26 Red Flags (Red flags identify foreseeable risks of identity theft)
  2. How to detect these flags in your everyday business
  3. How to respond to any red flags that are detected in order to prevent and mitigate identity theft.
  4. Compliance forms for your employees and service providers.

How do I start?

  1. Designate a Program Coordinator (This person reports to the business owner, partner, etc., or is the business owner themselves) The Program Coordinator as well as all owners will read “Developing your Dealership’s Written Program to Detect, Prevent, and Mitigate Identity Theft”. This will guide you through what to look for in red flags and what will be expected of you to detect and mitigate these flags or address discrepancies. You may want to read this several times to get a feel for identifying red flags.
  2. The Program Coordinator as well as the owners will carefully go through the “Dealership Identity Theft Red Flags and Notices of Address Discrepancy Policy”. This will serve as your template for your individual dealership. You will want to save this document where you can make changes to it. This is your template. This is your written program. You may find that there is a lot of information here that does not apply to your individual dealership. Delete it, (get rid of any Red flags that don’t apply to your daily business) change it, or add to it. Make it work for your business, and change it as needed. This will be your new written policy for preventing ID Theft.
  3. You can then train your staff to study the Red Flags Rules that you have chosen to be applicable to your dealership, be able to identify them as well as address discrepancies. Ask that each employee understand and sign the “Employee Acknowledgement of Notification & Training Regarding Compliance”.
  4. Send the letter that came with this packet addressed to “Service Provider” to all your vendors and service provides you currently hold an account with to ask that they comply with the current laws in safeguarding your information that you provide to them. This is another way to protect your company information that you give out.
  5. The “Addendum” is a form in which you can use to modify any contract you currently hold with a vendor or service provider stating that each party will comply with the Red Flags Rules and address discrepancies.

Ideally, this program should help make us all a little more aware of what to look for in all aspects of our lives, from the home, the office, shopping, internet, etc. We now have more tools to protect ourselves from being a victim of identity theft.

 

Please keep in mind that these materials are designed to assist dealers in the development of a written dealership policy for the detection, prevention and mitigation of identity theft and are intended to serve as a guide.  While not intended as a universal solution that every dealership can adopt, since they are drafted from a used motor vehicle dealer’s perspective, NIADA members should find that they are easy to use and customize for their dealerships. They may wish to consult with their legal counsel or other professional consultants to ensure that their dealership policies are appropriate and in compliance with applicable federal and state laws, rules and regulations.
